  7. Formation of the contract
    1. These terms of sale apply to all goods supplied by us, Home & Cook UK (Groupe SEB UK Ltd), registered in England no 01450244
    2. No contract exists between you and us for the sale of any goods until we have received your order and a confirmation of that order, which may be printed by you, has been displayed on your computer screen. Once you have received this confirmation, there is a binding legal contract between us.
    3. The contract is subject to your right of cancellation (see 11 below).
    4. We may change these terms and conditions of sale without notice to you in relation to future sales.
  8. Description and price of the goods and/or services
    1. The description and price of the goods and/or services you order will be as shown on our website at the time you place your order.
    2. The goods and/or services are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, we will inform you by email as soon as possible, and offer you an alternative product or refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods and/or services.
    3. Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, we will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods and/or services.
    4. In addition to the price, you may be required to pay a delivery charge for the goods, as shown in the section of our website about delivery.
    5. The price of the goods and/or services and delivery charges are inclusive of VAT. The VAT is charged at published UK rates for the supply for the UK territories at the time of order. Exports to the Isle of Man are charged at UK tax rates as per HM Revenue and Customs (HMRC) guide lines. We do not supply goods and/or services and delivery charges as an export on zero rate of tax to the Channel Islands. The VAT can be claimed back by the individual or business from HM Revenue and Customs (HMRC) in the UK, please visit their website for details of the method and rule(s) for the refund.
  9. Payment
    Payment for the goods and/or services and delivery charges can be made by any method shown on our website at the time you place your order.
  10. Delivery
    1. Delivery shall be to the address indicated in your order and if you pay by credit or debit card, only at the place where the card is registered ("Agreed Location").
      Please note that we are only able to deliver to addresses in the United Kingdom and the Channel Islands. All deliveries must be signed for.
    2. If Home & Cook delivers the items to the Agreed Location and if you are absent or fail to take delivery, then:
    3. Risk of loss and damage to the Items will pass to you;
    4. Home & Cook may store the Items until delivery whereupon you shall be liable for all related costs and expenses (including without limitation storage and insurance) from the agreed delivery date.
    5. Any delivery dates requested by you or stated in any order acknowledgement or confirmation are estimates only.
      Home & Cook cannot guarantee delivery on such dates and has no liability for failure to deliver on such specified dates. If delivery has not taken place within 7 days from the estimated delivery date, you should contact the Home & Cook customer service team. (as stated on the web-site)
    6. Home & Cook shall be entitled to make partial deliveries or delivery by instalments. Each such delivery shall be deemed to be a separate contract and any defect in anyone or more instalments shall not entitle you to repudiate the contract as a whole nor to cancel any subsequent instalment.
  11. Your right to Cancel
    1. Where the contract is for the sale of goods, you have the right (subject to paragraph 11.3) to cancel the contract at any time up to the end of fourteen working days after the day on which you receive the goods (see below).
      A working day is any day other than weekends and bank or other public holidays.
    2. Goods must never be returned without authorisation to the Home & Cook returns department. Any unauthorised return may delay or affect the value of credit given. To obtain authorisation for return please contact the customer service team on

    3. To exercise your right of cancellation, you must give written notice to us by hand or post, fax or email, at the address shown on our web-site giving details of the goods ordered and (where appropriate) their delivery.
    4. If you exercise your right of cancellation after the goods have been delivered to you, we will refund the full amount paid to you within 30 days. You will need to contact us first with your order reference number. Unless received damaged or faulty (see below) the items returned for refund must be received by us in a re-saleable condition. If you have opened the box to examine the product you must have done so without damaging or marking the product or packaging. The product must not have been used. It should be complete with any accessories and/or free gifts received with the product and in its original packaging. If the product returned is not in fully re-saleable condition or the packaging is damaged, we do reserve the right to refuse a refund on the item or deduct up to 20% of the original selling price from the refund amount. This does not affect your statutory rights.
    5. The goods must be returned to the Home & Cook returns department, the address will be provided to you when the returns request has been approved. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. If you do not return the goods in the manner required, we may charge you a sum not exceeding the direct costs of recovering the goods.
    6. Once you have notified us that you are cancelling the contract, we will refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods.
  12. Guarantee
    1. All goods supplied by us are guaranteed free from defects for the period stated on the product packaging from the date of supply. This Guarantee does not affect your statutory rights as a consumer.
    2. The Guarantee contained in paragraph 12.1 does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by us, failure to follow our instructions, or any alteration or repair carried out without our approval.
    3. If the goods supplied to you develop a defect while under Guarantee, or you have any other complaint about the goods and/or services, you should notify us in writing or by email at the address shown our web-site.

  13. Force Majeure

    Home & Cook reserves the right to defer the date of delivery or to cancel a Contract or reduce the volume of Products and/or Services which you have orders (without liability to you ) if Home & Cook UK is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control of Home & Cook UK which shall include without limitation acts of God, civil commotion, riots, flood drought, fire and legislation.

Nespresso Vertuo summer promotion 2021

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of these Terms and Conditions and by participating all participants will be deemed to have accepted and be bound by them. Please retain a copy for your information.

  1. This promotion is open to all residents of the UK, Channel Islands and Isle of Man, aged 18 or over and excludes employees and their immediate families of Nestlé S.A. and Nespresso, its agents or anyone professionally connected to the promotion.  Participants must register or be registered with Nespresso to qualify for the offer. 
  2. Applicants must have purchased any qualifying Nespresso Vertuo machine and registered with Nespresso during the stated promotion period to qualify for the offer. The offer consists of 100 complimentary pre-selected Vertuo capsules as a first gift, and one second gift of two free months’ (1st & 6th month) Nespresso Coffee Subscription worth £50 when participants go on to register and activate a Nespresso Coffee Subscription Plan by no later than 23:59 on 31.03.2022.   The 100 complimentary capsules will be made up of a pre-selected Vertuo range chosen by Nespresso which cannot be changed/substituted for any other variants.
  3. The stated Nespresso machine must be purchased between the stated dates from one of the associated Nespresso retail partners, or directly from Nespresso or by calling Nespresso on Freephone 0800 442 442 (UK), or at www.nespresso.com, or via the Nespresso App, or visiting a Nespresso Boutique where available. Maximum of one offer per machine purchased per Nespresso Member.  Any additional machines purchased during the stated promotional period will not qualify for the offer. The qualifying Nespresso Coffee machine must be purchased in the UK, Channel Island or Isle of Man. Due to the continuing COVID-19 situation, participants should check their local Nespresso Boutique opening days and times as these may vary.   4. How to claim: 

    Via another participating retailer

    - Customers must visit the promotional website at:  www.nespresso.com/ukoffer , complete an application form with their first name, last name, email address, residential address and daytime phone number, machine serial number (which can be found on the drip tray), and upload a photo of their qualifying till receipt showing the purchase of one of the specified Nespresso machines made between 09.06.2021 and 15.08.2021. Photos must clearly show the name of the store where the machine was purchased, the date purchased and the itemised machine details. Blurred, out-of-focus or photos where the till receipt is illegible will not be accepted.  Participants must claim their gifts by no later than 30.08.21.

    - The pre-selected, relevant number/type of complimentary coffee capsules and Coffee Subscription Box will be sent upon completion of a valid redemption made via the website. 

    Via www.nespresso.com 

    - Qualifying Nespresso Members are required to add their machine to their basket. Participants who are not already Nespresso Members will be required to register to qualify for the offer.

    -             The pre-selected, relevant number/type of complimentary coffee capsules and Coffee Subscription Box will be sent with their machine order.

    Via Nespresso Boutique 

    - Participants must visit their local Nespresso Boutique, register/be registered with Nespresso, and purchase the required Nespresso machine during the stated promotional dates. N.B. Due to the continuing COVID-19 situation, Participants should check their local Nespresso Boutique opening days and times, as these may vary. This can be done using www.nespresso.com/uk/en/store-locator. This page is updated regularly with the latest information and news relating to Nespresso Boutiques.  

    Via Customer Call Centre

    - Qualifying Nespresso Members are required to call the Customer Call Centre to place their order for any of the qualifying Vertuo machines with a Coffee Specialist during the stated promotional dates. Participants who are not already Nespresso Members must register to qualify for the offer. 

    -             The pre-selected, relevant number/type of complimentary coffee capsules and Coffee Subscription Box will be sent with their machine order.

    All qualifying claims for the free coffee, regardless of route used must be received by no later than 23:59 on 30.08.2021.

  5. If the qualifying participant goes on to register and activate a Nespresso Coffee Subscription Plan by no later than 23:59 on 31.03.2022 they will receive a second gift of two free months’ (1st & 6th month only) Coffee Subscription. Registration and activation of Coffee Subscription Plans can be made by visiting www.nespresso.com/uk/en/coffee-subscription-box and completing the registration process. Should the participant fail to register and activate a Coffee Subscription Plan by 23:59 on 31.03.2022 the offer of two free months’ subscription will become null and void.   6. The free Nespresso items are subject to stock availability and Nespresso reserve the right to supplement this offer with alternative items of equivalent value in the event of unforeseen circumstances or out of stock. No cash alternative will be available in lieu of the stated items.
  7. How long does the Nespresso Coffee Subscription last? The Nespresso Coffee subscription Plan will continue for as long as registrants continue to make their monthly payments and the contract will continue to roll until cancelled. It can be terminated by contacting the Nespresso Customer Relationship Centre on 0800 442 442 (UK), by sending an email confirmation to one@nespresso.com, or using the “Cancel” button in “My Account”. In the event of the subscription plan being terminated before the free 6th month, participants are unable to claim any cash or other alternative in lieu of the unused complimentary month.
  8. This promotion cannot be used in conjunction with any other Nespresso promotion, offer or discount including Nespresso Machine Subscription. Nespresso&YOU offers are still applicable when a Vertuo machine is purchased at RRP. The discounted Nespresso Vertuo machine offer cannot be used in conjunction with Nespresso&YOU offers.
  9. Nespresso reserves the right at its sole discretion to disqualify any individual found to be tampering with the operation of the promotion, setting up multiple accounts, using multiple identities or to be acting in any manner deemed by Nespresso to be in violation of the terms and conditions; or to be acting in any manner deemed by Nespresso to be disruptive.
  10. Those making claims on behalf of a company or business must be authorised to do so.
  11. If a participant returns their machine within 14 days, or the order cancelled, their ability to claim the free items will become null and void. If the complimentary items have already been dispatched, these must be returned unused and in their original packaging within 14 days at the participant’s own cost.
